(Washington) The two sides in dispute over Line 5 of the Enbridge cross-border pipeline are appealing a decision handed down last month by a Wisconsin court.

It was there that a district court judge gave Calgary-based Enbridge three years to reroute the controversial pipeline around Indigenous territory south of Lake Superior.

The Bad River Band of Lake Superior Chippewa, for its part, insists that the pipeline should be closed sooner. She wants the three-year deadline to be waived.

Enbridge, which is also unhappy with the decision, has already filed its notice of appeal with the United States Court of Appeals for the Seventh Circuit.

Bad River’s attorneys did the same on Thursday, saying in court papers that the two appeals should be consolidated.

Judge William Conley found in his ruling last month that Enbridge had indeed illegally entered band territory since 2013, a finding the company opposes.
