Since January 1, 2017, some AAH beneficiaries can now combine their allowance and their retirement pension. It was the Finance Law for the year 2017 which finally overturned the decision obliging people with disabilities to switch to the ASPA system when they retire. This system had, in fact, various disadvantages, in particular the obligation to transfer one’s file and a significant loss of resources. What are the current rules for combining retirement and AAH?

Thanks to the Finance Act passed in 2017, people with disabilities can continue to receive the AAH after reaching the legal retirement age. In this way, a transfer to ASPA is no longer necessary and it is therefore possible to continue to receive the increase for independent living for all beneficiaries. The combination of the AAH and the pension is however limited to certain people: it is essential to fulfill several conditions in order to benefit from it. Thus, you must have at least a permanent disability rate of 80% and have reached the legal retirement age after January 1, 2017.

Other conditions are necessary to claim this accumulation, such as a contribution in good standing to old-age insurance and the payment of a pension lower than the amount of the AAH, namely 971.37 euros per month. If you do not have any steps to take to maintain your AAH, you must nevertheless submit a retirement application to the funds to which you have contributed so that the payment of your AAH is not interrupted. Also be careful if you receive an old-age pension since your AAH could be reduced depending on the amount of your pension.
