Top country court judgment: the service fee is part of the cruise price

Mandatory gratuities on a cruise must be specified in the advertised trip price. This decision from December, the Schleswig-Holstein higher regional court announced now (Az. 6 U 24/17).

The defendant company that provides boat trips, had advertised a total price for a cruise. This is a service fee of 10 euros per day must be paid according to the contractual terms and conditions of every cruise guest was missing, however. It was not only calculated, if the guest spends a night on Board.

According to the case law of the Federal court of justice is under the term “total price” is the price that must be paid including value added tax and other ingredients from the consumer to the court.
