The Government removes the restrictions imposed on the advertisements of betting houses during the state of alarm

The Government has repealed the restrictions imposed during the state of alarm to the advertising of the online game. As released by the BOE this Wednesday, the rules that will govern the “new normal” ends with the prohibition of the advertisements of betting houses. Among the provisions of the Royal Decree-law 21/2020, of 9 of June figure the repeal of article 37 of the Royal Decree-law 11/2020 of 31 march, which were adopted as urgent measures to address the coronavirus

This repeal was made “for consistency with the greater flexibility in terms of game established during phases II and III of the Plan for the Transition to a new normal,” according to the text itself. The measures of restriction on commercial communications by the entities that carry out a gaming activity is regulated in the Law of the game affecting “any form of advertising, disseminated by any medium or support, intended to promote” these “directly or indirectly”.

According to the aforementioned article 31, during the time of validity of the declaration of a state of alarm were banned advertisements that made reference to the situation of exceptionality that stems from the disease by coronaviruses or explained to the consumption of gambling activities in this context.

During the effective period of the state of alarm, nor was it possible to carry out promotion activities aimed at attracting new customers or the loyalty of existing customers that pick-up welcome bonuses or discount. Nor can they issue campaigns of this sector except in the time slot between 1 and 5 a.m. , a number of measures that the minister of Consumption, Alberto Garzón, had planned to approve the next July.

Before the football season

a few months Ago, the Ministry of Consumption made public and the royal decree that will regulate the advertising of the game with more than 100 measures aimed at limiting, but not to prohibit the advertisements of the sector . In the second transitional provision was that the royal decree would enter into force on 1 July 2020 and that there would be a period of three months to the operators to adapt the contracts in force.

From the Ministry of Consumption indicated then that the aim was that the standard is ready to be approved during the next summer that could be applied before the start of the new football season
