Since the announcement of the pension reform project initiated by the executive, the voices of the French have been outraged against the extension of the legal retirement age. For many, raising this age from 62 to 64 means a deteriorated quality of life and an obligation to continue working which creates debate. In this context, some are considering the possibility of stopping work before this legal age. What would be the consequences of such a decision?

While the text of the law has just been validated by the Constitutional Council and Emmanuel Macron hastened to promulgate the reform, the fight continues for the French, the unions and the opposition who are seeking new solutions to prevent the law enforcement. The rejection of the motion of censure filed after the use of article 49-3 had thus showered the first hopes while the wait for the examination of the text by the Constitutional Council had turned into mad hope. However, none of these procedures succeeded in preventing the law from being promulgated.

Currently, the shared initiative referendum proposed by Nupes has also been rejected by the Constitutional Council. A second has been filed with the Constitutional Council, which must examine it by May 3. This is a second chance, which is also based on the ban on raising the legal retirement age beyond 62. Socialist parliamentarians also want to propose a repeal law, which could remove the legal retirement age.

With the pension reform, the legal retirement age will be raised to 64. You will be able to benefit from your retirement with a departure without discount if you justify the number of quarters required, estimated at 43 annuities. The legal age of the full rate remains, meanwhile, set at 67, as promised by the government.

However, it will be possible to leave before the age of 64 in certain cases. The executive has thus set up a long career scheme, which concerns people who started working before the age of 20. The earlier you start labor, the earlier you can leave. Special measures have also been created for situations of disability or occupational illnesses.

What happens if you decide to leave before the age of 64 when you do not benefit from a specific device? This is the question that the director of the specialized firm Sapiendo retirement had to answer during a webinar organized by Capital. His answer was conclusive, explaining that “even if this person has a big jackpot on his retirement savings, the rules are the rules”.

She added that it was not possible to make this decision outside of specific arrangements such as long careers, taking into account hardship or even certain categories of the public service. In any case, you can stop working before “but you will not have pension rights”, which means that you will have to live on your savings for two years if you make this choice. Your retirement pension will also be subject to a reduction at the time of the legal retirement age in the event of a lack of required quarters.
