Automatic retirement: at what age is it imposed on you?

With the recent pension reform, the French will have to work two more years. From 62 years old, they will now have the obligation to work until 64 years old, except in special cases such as situations of disability, long careers or even arduous jobs. If this threshold is anchored in the minds, just like the age of the full rate, always established at 67 years, it is less obvious to know until what age it is possible to work. Is there a limit, an age at which an automatic retirement can be imposed on you?

It is quite possible that your employer decides to retire you automatically. For this, you must have reached at least the age of 70. If you are between 67 and 70 years old, your employer may, in this context, offer you to retire, but you are not obliged to accept his request. Before age 70, your employer has the ability to ask you in writing about your desire to leave his company. This request can be addressed to you three months before your 67th birthday. You have one month to respond to your employer.

In this first case, you can simply accept this proposal from your employer. You are also allowed to refuse it. Your employer does not have the right during this period to automatically retire you. He nevertheless has the possibility of questioning you, each year, up to and including your 69th birthday. From the age of 70, your employer can, this time, automatically retire you. Your consent is not required in this case. Your retirement date is then set taking into account a notice period, the duration of which is identical to the notice period provided for in the event of dismissal.
