The Official State Bulletin (BOE) published on Thursday the Law 1/2020, of 15 July, which repeals article 52 d. of the Workers ‘ Statute, which endorses the termination goal for low medical accumulated in a given time.
The law, which will come this Friday, in force, was adopted on 1st July in the Congress, with the vote against VOX and the abstention of the PP. However, the repeal of the article is already in force since the adoption of the decree law.
In the preamble of the act sets out that “the dismissal of sick people not only connects with the right to non-discrimination by reason of disability, as has been noted on numerous occasions by the Court of Justice of the European Union (CJEU), but that also generates the hard-working person who sees snuffed out his contract, a situation of great vulnerability professional, personal and social.”
The BOE also published on Thursday a change to the conditions of the ERTE until the 30th of September, in particular about processes externalizaciones of activity for companies accepted to one of these files and not be able to establish new but yes to resume the existing.
